New Fees Explained
From the 6th of November 2026, the Ministry of Housing Communities and Local Government has introduced new fees called:
“The Building (Local Authority Charges and Amendments Relating to Charging) (England) Regulations 2026”.
This will mean that additional charges will be made in relation to each project including the submission of new applications, amendments, and other statutory functions. There is no standard charging structure, with each Local Government Authority setting their own fees, which will need to be paid up-front before notices can be filed.
How this works for our clients
Initial Notices
After we have received an application, our Administration team will assess the fee charges for submitting the “Initial Notice” with the relevant Local Government Authority and call the Client (or bill payer) to advise them of the relevant costs. The Client (or bill payer) will need to make a card payment or bank transfer to us and, once funds have been received, we will process the application and submit the Initial Notice. Customers without account facilities will also need to pay our registration fee, which is £250.00 for domestic projects and £500.00 for commercial projects (plus VAT).
Final Certificates
If we are satisfied at the end of the project that the work undertaken meets the functional requirements of the Building Regulations, then we will then contact the Client (or bill payer) again and advise them of the relevant Local Government Authorities filing fees. We will request that payment is made via a card or bank transfer to us and, once funds have been received, we will process the “Final Certificate” and submit this with payment to the relevant Local Government Authority.
Amendment Notices
In some circumstances we are required to submit what is called an amendment notice when details of the project have changed following submission of the “Initial Notice”.
This is normally required when the description of work changes, there has been a change of Principal Contractor or Client/Homeowner, and/or there has been an amendment to a site address.
Like the above processes, we will then contact the Client (or bill payer) again and advise them of the relevant Local Government Authorities filing fees. We will request that payment is made via a card or bank transfer to us and, once funds have been received, we will process the “Amendment Notice” and submit this with payment to the relevant Local Government Authority.
Customers without account facilities will also need to pay our amendment fee for processing these unexpected alterations (which is currently £70.00 plus VAT). We will also advise them on additional project fee costs if the scope of our work on the project has increased due to additional works.
Extension of Time
We are required under current legislation to issue a “Final Certificate” within 8 weeks of occupation or practical completion for domestic projects and 4 weeks for commercial projects.
In some circumstances where there are minor outstanding items, we can request an extension of time for up to 3 months from the relevant Local Government Authority. Again, if this incurs a fee, we will contact the Client (or bill payer) again and advise them of the relevant Local Government Authorities filing fees.
We will request that payment is made via a card or bank transfer to us and, once funds have been received, we will process the “Extension of Time” and submit this with payment to the relevant Local Government Authority along with our notice.
Cancellations and Reversions
Regrettably, in some circumstances where the project hasn’t gone to plan and we have issued “Contravention Notices” which have not been rectified or we deem the structure to be unsafe and/or there has been a breach of our contractual terms and conditions, we may look to cancel or revert the project.
In these circumstances, we will put you in touch with your Local Government Authority who will advise you of their fees (which need to be paid directly to them), and also the next steps in the Cancellation/Reversion process.
